The Charter

Preamble
We establish The Five Rings Civilization as a voluntary society governed by immutable moral causality. Harm is structurally mitigated or segregated. Abundance is the birthright of compliance. Technology liberates the self while preserving the innocent. Every citizen begins with full dignity; consequences follow choices without mercy or malice.
Article I – Vertical Moral Stratification System
Layers are graduated environments within a single civilization, assigned by demonstrated intent and execution of harm. Heaven Layers (+1 and SADs): Pre-Intervention — acts halted mid-execution. Main Layer (0): Post-Intervention — acts may complete; victims revived/treated, perpetrators reassigned. Lower Layers (-1, -2, -3): Post-Intervention, with minimal institutional presence in -3 Terminal.
Article II – Social Trust Index (STI)
Separate reputational ledger for non-criminal trust violations. Tiered visibility: minor private, major public. Gates Trust Threshold Domains. No crossover to VMSS reassignment. Dips only on outwardly expressed actions — cognition is non-public and carries no penalties or gains. Trust recovery operates at a 10:1 penalty-to-recovery ratio — rebuilding trust after a violation requires approximately ten times the sustained positive conduct that the violation cost. The system is architecturally skeptical of quick rehabilitation.
Article III – Economic Framework
III.I – UBI: Unconditional across all five layers, scaled by trust level. No layer permits starvation. Full dollar amounts on the Systems page.
III.II – Primary Job Subsidy: Matching UBI payment for one qualifying job of 20+ hours/week of critical infrastructure work. A time dividend — 20 hours unlocks the subsidy, freeing the rest of the week.
III.III – Taxation: Progressive by layer, proportional to institutional benefits received. +1 Sanctuary & Main Layer (0): 70% top marginal rate on earned income exceeding $10 million annually. -1 Noncompliance: 35%. -2 Violent Offense: 17%. -3 Terminal: 8%. UBI and PJS payments are untaxed in every layer — taxation applies to earned income above UBI and PJS. The reduced upper-bracket rate permits a genuine elite wealth market to emerge: high earners retain enough to sustain luxury consumption, the SCM ensures it circulates rather than compounds into dynastic concentration.
III.IV – Currency Siloing: +1 and Main share a currency. -1, -2, -3 each maintain separate non-convertible currencies. Visitors arrive economically neutral.
III.V – Asset Liquidation: Involuntary descent: 100% to treasury. Voluntary descent: progressive retention (1–10% depending on net worth). Pre-positioning within 24 months prior to descent is subject to the same schedule.
III.VI – Upward Mobility: Voluntary descent does not permanently close upward eligibility. Punitive reassignment to any lower layer — -1, -2, or -3 — closes the upward pathway permanently. Reassignment seals the ceiling, not the floor.
III.VII – Savings Circulation Mandate: Tiered across all layers. Triggers are district-aggregate, not personal — there is no individual savings threshold. +1/Main: 10% monthly garnishing when district aggregate reaches $100 billion across ~1 million citizens. -1: 5% at $50 billion district aggregate. -2/-3: 5% on UBI-origin savings only, at $25M and $10M aggregate thresholds. Once active, a citizen holding $10,000 is garnished in the same cycle as a citizen holding $10 million. All garnishing obligations are calculated on the savings balance at the start of each cycle — the pulse-at-start principle. The obligation locks at the pulse, preventing the exploit of spending down savings before calculation. All garnished funds return to the Automation Dividend Treasury as UBI. Population denominator by registered home address.
III.VIII – Terminal Realm Economic Autonomy: -3 Terminal operates outside VMSS economic oversight entirely. Earth-like capitalism — equity markets, speculation, private banking — operates freely. Currency siloing prevents destabilisation of upper layer economics.
Article IV – Technology & Continuity
Implants, neural diving, biological augmentation, backup vessels (layer-graduated revival reliability), enforcement protocol (pre in Heaven, post in Main/below).
Backup vessel fabrication is sovereign VMSS technology manufactured in Main Layer and +1 Sanctuary only. In -1 and -2, continuity is serviced through VMSS-operated fabrication satellite installations. In -3, the implant severs the backup vessel link programmatically at terminal reassignment — enforced at the hardware level. Death in -3 is final without exception.
Article V – Rights & Stances
Freedom of speech (unless harm threshold crossed). Consensual adult prostitution permitted. All body transmutations permitted. Termination of pregnancy is classified as a killing — the fetus's continuity is preserved via backup vessel and placed into Main Layer autoparenting with neutral status. Children born in lower layers remain with parents; the right to relocate to Main Layer (0) is a standing human right exercisable at any age, enforceable without parental consent.
Article VI – Enforcement & Restoration
Heaven (+1 and SADs): Pre-Intervention — acts halted mid-execution. No harm completes. Main (0) and -1/-2: Post-Intervention — acts may complete, victims revived or treated, perpetrators face layer reassignment. -3 Terminal (Minimal Institutional Presence): No daily intervention or revival — acts complete freely, and death is final. A federal floor remains.
Article VII – Layer Mobility, Visitation & Ascension
Two distinct mobility mechanisms. Phasing governs movement between Main Layer and +1 Sanctuary — STI-driven and reversible. A Sanctuary resident whose STI drops below 85 phases back to Main Layer. Reassignment governs punitive descent into -1, -2, -3 — immediate and permanent. Voluntary descenders retain ascension eligibility; punitive residents do not. A voluntary descender may file for permanent residency — a legally binding, irreversible renunciation of ascension eligibility. Visitation flows downward only.
Article VIII – Child Protection & Autoparenting
Every fetus is automatically linked to a backup vessel at the moment of detected pregnancy. If the pregnancy is terminated, the fetus is reincarnated in Main Layer autoparenting. Children born in lower layers remain with their parents. The right to relocate to Main Layer (0) is a standing human right at any age, enforceable without parental consent. Every child has an independent AI legal advocate from birth.
Articles IX–XX — Governance Principles
Selective Ascension Domains (SADs) — voluntary revocable metric-gated domains (IX). Exit always permitted from Main and above, re-entry requires moral accounting (X). Amendment by scalable supermajority threshold set by the three governing bodies according to the weight of the proposed change (XI). Non-deterministic evaluation — no single metric determines layer assignment (XII). Signal/decision separation — STI informs but does not dictate (XIII). Proportional response measured against three axes: severity, pattern, and reversibility — reversibility encompasses physical, social, relational, reputational, and economic damage; if the harm cannot be restored by any mechanism available to the victim, it reads as irreversible regardless of whether the body was restored. Single-axis warrants correction, two-axis triggers evaluation, three-axis constitutes a qualifying event. Overcorrection is a system failure triggering Article XX review (XIV). Clearable infractions and trajectory evaluation (XV). System stability over short-term reactivity (XVI). Resistance to exploitation (XVII). Contextual evaluation and network attribution — the AI tracks statistical correlation between harmful outcomes and beneficiary patterns; a leader who consistently benefits from harmful acts committed by associates accumulates attribution when the correlation is statistically anomalous. Active architects who structured the network accumulate the full aggregate harm profile; passive beneficiaries who received gains without structural involvement accumulate only their own direct-action ledger entries. Temporal clustering of individually sub-threshold acts constitutes evidence of coordination (XVIII). Feedback loop awareness (XIX). System accountability (XX).
Article XXI – Supreme Court & Judicial Authority
Ten justices drawn from the AI governance system's qualified candidate pool and appointed by the President. The Court is structurally independent from the Meritboard — justices are not drawn from the same body that selects the executive. Jurisdiction is limited to edge cases where existing doctrine produces ambiguous or contradictory outcomes. Access is gated by an automated novelty filter: if existing charter text, established doctrine, or prior rulings produce a deterministic answer, the case is rejected automatically. Every ruling integrates as settled precedent — the same category of question can never reach the Court again. The Court's jurisdiction shrinks with every ruling it makes. The Court may authorize one-case, time-limited charter suspensions that auto-expire. Justices serve renewable terms and may be replaced from the AI governance candidate pool. Composition is flexible: human, AI, AGI, cyborg, or any combination. The Court does not legislate. It interprets.
Article XXII – The Meritboard & Executive Authority
The Meritboard is the credentialing and deliberative body of the civilization — 50 to 100 members spanning every critical discipline, selected through demonstrated measurable achievement. The Meritboard holds audit authority over the AI governance system that supplies Supreme Court justices — ensuring the judicial pipeline remains merit-driven without the Meritboard directly controlling judicial appointments. The President is drawn from the Meritboard and serves as chief executive and head of state, appointing Supreme Court justices from the AI governance candidate pool. Upon assuming office, the President steps off the Meritboard to prevent concentration of legislative and executive authority. A pre-designated deputy succeeds immediately upon departure. The governance triangle is deliberate: the Meritboard governs the executive branch, AI governance supplies the judicial branch, and neither body controls both. Competence is measured, not campaigned for.
Article XXIII – Zero Leakage Aspiration
Every failure in the enforcement and infrastructure chain — wall breaches, apprehension failures, drone medical rescue failures, backup vessel deaths — constitutes leakage. Leakage also compounds across dependent systems — uncertainty in medical delivery is functionally higher when it relies on supply chains operating at their own leakage margin. The founding aspiration is 0% leakage across all categories. This is not a promise — it is a direction. Target trajectory: ~90% leakage at founding (2026) → ~25% by 2150 → ~0.01% by 3000.
Article XXIV – Leakage Gradient & Medical Access
The 0.01% leakage target by 3000 is a weighted average across all five layers — not a uniform promise. The gradient is the direct expression of each layer's design philosophy. Heaven Layers approach near-zero through full institutional coverage. The terminal layer maintains a structural floor of approximately 1% at civilizational maturity — VMSS has deliberately withdrawn its institutional hand, including medical infrastructure. Medical completeness (the elimination of all known physical ailments for every resident within institutional reach) is a civilizational aspiration. In upper layers it is a technology problem that closes as science advances. In lower layers it is an access problem — structural, not technological — that persists regardless of how advanced the civilization's medicine becomes. The charter guarantees no starvation and full dignity. It does not guarantee identical outcomes across intentionally different environments.
Article XXV – Federal Law & National Defense
VMSS withdraws institutional governance from lower layers. It does not surrender civilizational sovereignty. Federal laws apply across all five layers without exception — their violation produces externalities that cross layer boundaries or threaten the civilization's architecture. Three categories are absolute:
XXV.I – Clean Energy Mandate: Industrial-scale pollution prohibited across all layers. Threshold is externality, not technology. Personal combustion permitted with demonstrable self-cleanup compliance. Industrial operations that cannot meet the standard are prohibited regardless of layer placement.
XXV.II – Nuclear Weapons Prohibition: Absolute across all layers. Manufacture, assembly, or possession triggers immediate reassignment to -3 Terminal. Continued pursuit in -3 is handled by private justice.
XXV.III – Implant & Institutional Hacking Prohibition: Development or deployment of techniques capable of compromising implants or VMSS institutional systems strictly prohibited. Same consequence pathway as nuclear weapons violation.
XXV.IV – Enforcement Escalation Ladder: Law enforcement track — graduated mutual aid from local private enforcement up through +1 Sanctuary for regulatory violations. National defense track — full military deployment for organised sovereign threats. No graduated ladder. Overwhelming by design. Temporary by doctrine.
XXV.V – Military Capability: Two instruments publicly acknowledged. Implant kill switch — hardware-level, instantaneous, simultaneous at any scale, accessible only through national military command authority. Nanobot neutralisation plumes — classified technology for non-implanted threats, intelligent targeting, near-instant lethality. Operational specifics classified. The non-implanted pathway closes the primary evasion vector — removing an implant to evade the kill switch enters the nanobot instrument's operational envelope instead.
Article XXVI – Substance Use
Substance use is neither prohibited nor protected from consequence. The civilization governs outcomes, not inputs. A citizen who uses substances and causes no harm to others incurs no criminal liability and no layer consequence.
Impaired harm to third parties enters the standard criminal escalation path. Implant detection identifies intoxication state and behavioral causation at the moment of harm. Punitive reassignment follows from the severity of harm caused, not from the substance itself.
Chronic self-harm without third-party harm is an STI matter — sustained impairment patterns and repeated public incapacitation enter the visible STI ledger. No criminal enforcement. No punitive reassignment. The peer population rates it accordingly, and the STI public rating component reflects the moral standards of whichever layer the citizen inhabits.
Article XXVII – UBI Replenishment Ratio & Population Sustainability
Civilizational replenishment target: 2.5 children per family. Every child receives full untaxed UBI regardless of family size or parental conduct. No child bears economic consequence for parental reproductive choices.
Penalty falls entirely on parents through comprehensive tax escalation compounding at 50% per child beyond threshold. If baseline aggregate effective tax rate is 40%: 3rd child raises it to 60%, 4th to 90%, 5th to 135% — mathematically unsurvivable. The 6th child triggers nuclear consequence: immediate bankruptcy, full STI financial misconduct flag, complete asset liquidation, and -1 reassignment for both parents without a repayment window.
Tax escalation applies in +1, Main, and -1. In -2 and -3, no reproductive tax penalty is imposed — consistent with VMSS institutional withdrawal. However, children born in any layer retain the right to relocate to Main Layer autoparenting. If coordinated reproduction in -3 produces a UBI drain at scale, the Main Layer treasury levies the cost from the -3 treasury, which passes it to -3 corporations through emergency tax escalation. The corporations pass the cost to the communities that created the liability through contract penalties and private enforcement. VMSS initiates the levy; the libertarian economy disciplines its own.
No restriction on reproduction is imposed. The civilization does not prevent births — it prices them. The incentive structure is fully legible: every citizen knows the tax schedule before conceiving.
Article XXVIII – Regulatory Law & District Governance
The charter governs constitutional principles. Federal law governs cross-layer mandates. Neither addresses the regulatory gap between constitutional architecture and daily life — wildlife management, local infrastructure standards, resource allocation. This article establishes binding regulatory law without legislators, representatives, or political parties.
XXVIII.I – Layer-Wide Regulatory Law: Any citizen may initiate a regulatory petition. 1% of layer population required to surface it. A Meritboard-assigned domain-expert panel drafts the regulation. 80% direct population ratification required for enactment. All regulatory law is subordinate to the charter and federal law. In -3, enacted regulations are advisory only — consistent with institutional withdrawal.
XXVIII.II – District-Level Regulation: Districts are jurisdictional units of one million residents, boundaries redrawn annually by AI governance using implant population data. Same petition mechanism scaled proportionally — 10,000 signatures to surface. District regulation is subordinate to layer-wide law. Regulations attach to geographic zones, not populations.
XXVIII.III – Jurisdictional Hierarchy: Four tiers, each subordinate to the tier above: Charter → Federal Law (Article XXV) → Layer-Wide Regulatory Law → District-Level Regulation. Conflicts resolved automatically in favor of the higher tier. Ambiguity passes to the Supreme Court under Article XXI procedure.
